Strict Liability For Injuries Occurring at Commercial Properties
The Massachusetts Supreme Judicial Court had recently ruled that commercial or public buildings (potentially including large residential complexes) who are in violation of building codes regulations, will be held strictly liable for any injuries that occur to a person who enters onto those premises. Sheehan v Weaver, SJC- 11395. The ruling should place more pressure on building owners, who choose to ignore safety regulations, to correct defective conditions and make it easier for persons injured, as a result of that negligence, to recover compensation for injuries they sustain.
